Terms of service
1. Overview
This website is operated by Muldoon’s Performance Transmissions, LLC (“MPT,” “we,” “us,” or “our”). By accessing or purchasing from muldoontransmission.com (the “Site”), you agree to these Terms of Service (the “Terms”). If you do not agree to these Terms, do not use the Site.
2. Eligibility and Acceptable Use
You must be at least 18 years old and legally able to enter into a binding contract.
You agree to use the Site only for lawful purposes and not to:
- Violate any applicable law or regulation
- Infringe intellectual property or privacy rights
- Attempt to interfere with the Site’s security or operation
- Misrepresent your identity or authorization to use a payment method
3. Products, Lead Times, and Fitment
Many products, including transmissions, torque converters, and valve bodies, are built to order. Published lead times are estimates only and begin once production starts.
Typical Inventory Status
- Valve bodies are usually in stock.
- Superstock, Towmaxx, and Stage 1 68RFE transmissions are usually in stock.
- Stage 1 and higher transmissions are built to order and typically require 1–3 weeks once production begins.
- Built-to-order items generally ship within 1–3 weeks after production starts unless otherwise noted.
Fitment, calibration, tuning, and vehicle setup are the customer’s responsibility unless otherwise stated in a written work order.
High-performance and/or off-road use may increase wear and risk. The customer assumes responsibility for operating conditions, tuning choices, tire size, stall speed, gearing, and driving style.
4. Orders and Acceptance
Your order constitutes an offer to purchase. We may accept, reject, or limit quantities at our discretion, including in cases of suspected fraud, pricing or description errors, or supply issues.
An order is accepted when we send a confirmation email. Built-to-order items cannot be canceled once production begins.
5. Pricing, Taxes, and Errors
Prices are listed in U.S. dollars and may change without notice. We collect taxes where required.
If we discover a pricing or description error, we may cancel and refund the order or request your confirmation to proceed at the corrected price.
6. Payments
We accept Shopify Payments, including Shop Pay, Apple Pay, and Google Pay, as well as major credit cards.
By submitting a payment method, you confirm that you are authorized to use it and authorize us to charge the full amount, including taxes, shipping, and any applicable core charges or deposits.

7. Shipping and Risk of Loss
Shipping options and costs are displayed at checkout.
Risk of loss transfers to you when the carrier marks an order as delivered.
Please review our Shipping Policy for freight requirements, delivery appointments, liftgate service, damage-claim procedures, and international duties.
8. Core Exchanges and Deposits
Some products require the return of a core, or used unit. Core charges or deposits are stated on the applicable product pages and invoices.
Please review our Refund and Core Return Policy for return deadlines, acceptable core conditions, inspection procedures, and refund processing.
9. Returns and Refunds
Returns are governed by our Refund and Core Return Policy.
Certain products are non-returnable, including electronic parts, transmissions, valve bodies, and DIY build kits. An RMA is required for all returns.
For customers in the European Union, where applicable, you may exercise your right of withdrawal in accordance with Directive (EU) 2023/2673 by using the “Submit Withdrawal” button located in the footer of every page.
Refunds issued in connection with a valid withdrawal request will not be subject to a restocking fee.
10. Warranties and Disclaimers
Except as expressly stated in a product-specific written warranty, products are provided “as is” and “as available,” without other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Performance results may vary depending on vehicle use, tuning, and operating conditions.
11. Limitation of Liability
To the maximum extent permitted by law, MPT will not be liable for indirect, incidental, special, or consequential damages, including loss of profits or loss of use.
Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product at issue.
12. Indemnity
You agree to indemnify and hold MPT harmless from claims, damages, and costs, including reasonable attorneys’ fees, arising from product misuse, installation errors, unsafe modifications, violation of these Terms, or violation of applicable law.
13. Chargebacks and Disputes
Before filing a chargeback or payment dispute, please contact info@muldoontransmission.com so we have an opportunity to help resolve the issue.
Unauthorized or bad-faith chargebacks will be contested using order records, delivery confirmation, and applicable policy information.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.
You agree to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware. You may also pursue claims in small-claims court where permitted.
15. Intellectual Property
All Site content is owned by or licensed to MPT and is protected by applicable law.
You may not use our trademarks, photographs, videos, or technical documentation without prior written permission.
16. Privacy
Please review our Privacy Policy to learn how we collect, use, and share information.
17. Changes to These Terms
We may update these Terms by posting a revised effective date above.
Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
